Private Security Sector Specific Laws and Regulations
Over and above laws that govern all organizations within South Africa such as the Companies Act, Income Tax Act and Labour Relations Act to name a few, there are specific laws and regulations that specifically apply to the Private Security Industry within which we operate.
Sectoral Determination 6
The Sectoral Determination regulates the terms of conditions of service of certain categories of employees within the sector. It includes issues such as annual, sick and family responsibility leave, minimum wages for the various categories of employees and many more.
The Sectoral Determination is gazetted in terms of section 51 (1) of the Basic Conditions of Employment Act. It is preceded by the conclusion of an agreement between employer organizations and trade unions representing the industry through the Bargaining Forum for the Private Security Sector.
Private Security Regulatory Act
The Act enables the establishment of the Private Security Industry Regulatory Authority. The primary aim of the authority is to regulate the industry and to exercise control over the practice of the occupation of service providers. In achieving this PSIRA fulfills a myriad of functions which include:
- Ensuring compliance to existing legislation
- Promoting high standards in the training of security service providers
- Determine and enforce minimum standards of occupational conduct in respect of security service providers
Private Security Sector Provident Fund Rules and Amendments
Each employee, subject to certain exclusions as set out in Sectoral Determination 6 that falls within the definition of an eligible employee must be a member of the Private Security Sector Provident Fund (PSSPF). Practically, for the consumers of private security services this means that all security officers should be members of the PSSPF, by law. The fund is currently administered by Absa Consultants and Actuaries.
